EULA - End User License Agreement

The following is a legal software license agreement between you, the software user and Datum.

THE SOFTWARE (DATUM-WHOIS) IS LICENSED, NOT SOLD, AND AVAILABLE FOR USE ONLY UNDER THE TERMS OF THIS LICENSE AGREEMENT. PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS, DO NOT INSTALL THE SOFTWARE.

Grant of License. This license permits you to install/use the Software for FREE on multiple computers subject to the restrictions below:
1. You may not sell, rent, lease, or sub-license the Software or portions thereof
2. Reproduce, distribute or transfer the Software without prior consent from Datum (Datumza.com)
3. License holders may alter or modify the software for their own use, but may not resell redistribute or transfer the modified, or derivative version
4. Extract sub-components from this Software to be used in other Software
5. Use the Software for sites with violence or that promote racial hatred
6. Use the Software for sites with adult content
7. Use the Software for any illegal purposes

Copyright. The Software contained in this package is owned by Datum and is protected by international copyright laws, international treaty provisions, and all other applicable national laws. The Software must be treated like all other copyrighted materials (e.g. books and musical recordings). This Agreement does not grant you any intellectual property rights in the Software. License holders must display "Copyright 2013 Datum - All rights reserved" notices on every page generated by the Software. All copyright and proprietary notices in all components of the Software must remain intact.

No Warranty. The Software is being delivered to you "AS IS". Datum does not and cannot warrant the performance or results you may obtain by using the Software or accompanying documentation. Datum make no warranties, express or implied, as to the non-infringement of third party rights, merchantability, or fitness for any particular purpose.

No Liability for Consequential Damages. In no event shall Datum be liable for any damages whatsoever (including but not limited to damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) which results from an inability to use this software, even if Datumza.com has been advised of the possibility of such damages. YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE.

Indemnity. You agree to indemnify and hold harmless Datum for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of the Software, or a violation of any terms of this license.

Termination. Without prejudice to any other rights, Datum may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software.

Restricted Rights. The Software and documentation are provided with Restricted Rights.
